LUXE DEN LLC – RENTAL TERMS & HOUSE RULES

PREAMBLE – LEGAL BASIS OF THIS AGREEMENT

By booking the property—whether directly through Luxe Den LLC or via any third-party platform such as Lodgify, VRBO, Airbnb, or their affiliates—and by entering or remaining on the premises, Guest agrees to be legally bound by the following terms and conditions. This document constitutes a revocable license to occupy the property—not a lease or tenancy—and defines the scope, duration, and limits of permitted use.

This agreement supplements and, where applicable, incorporates any terms set by the booking platform, including cancellation, damage, dispute, and arbitration provisions. In the event of conflict between external platform terms and this agreement, the more restrictive or protective provision in favor of Luxe Den LLC shall apply.

Occupancy is granted solely for short-term lodging as defined under Utah law. Luxe Den LLC retains all rights of control and access consistent with Utah Code § 29-2-103 and related statutes governing short-term innkeepers.

0. Definitions and Responsibility

  • &quotGuest&quot refers to the individual who completes the reservation and any other person who occupies or visits the premises during the booking period, regardless of whether they are listed on the reservation.
  • The booking Guest must be at least 18 years old and is deemed the responsible party for the entire reservation.
  • The booking Guest accepts full financial and legal liability for the actions of all occupants, companions, invitees, service providers (e.g., pet sitters), and pets associated with the stay.
  • All obligations, waivers, fees, indemnities, and damages outlined in this agreement apply jointly and severally to the booking Guest and all persons under their control.
  • No individual may take possession of or remain on the premises without being subject to the terms of this agreement.

1. License to Occupy and Duration of Stay

Guest is granted a limited, revocable license to occupy the designated guest suite solely for short-term lodging. This license begins at 3:00 PM on the arrival date and ends at 11:00 AM on the departure date as confirmed by the booking platform. This agreement does not constitute a lease or tenancy and conveys no right, title, or interest in the property under Utah landlord-tenant law.

If the total stay—including extensions, back-to-back bookings, or continuous occupancy—equals or exceeds 30 consecutive nights, the following terms apply:

  • Guest acknowledges and agrees that no month-to-month tenancy, periodic tenancy, or long-term lease is created.
  • Guest expressly waives all rights or protections under Utah Code § 57-22-1 et seq. (Utah Residential Landlord and Tenant Act).
  • Any continued occupancy beyond the reserved end date requires a separately executed written lease agreement, signed by both parties prior to the extension.
  • Guest agrees to vacate the premises at the end of the reservation period without the need for formal eviction proceedings and acknowledges that unauthorized holdover may constitute criminal trespass under Utah Code § 76-6-206.

2. Premises and Allowed Areas

The licensed premises consist exclusively of the basement-level guest suite and the fenced adjacent yard area. All other portions of the property—including but not limited to the main floor of the home, any upstairs areas, attached garage bays, utility closets, and locked storage rooms—are expressly excluded from this agreement.

Guest acknowledges that this license does not create any tenancy or right of access to areas beyond the defined guest space. Entry into any restricted or non-licensed area is a material breach of this agreement and constitutes trespass.

3. Occupancy and Guest Responsibilities

Maximum overnight occupancy is limited to four adults. No additional overnight guests are permitted without written approval. Unauthorized guests will incur a charge of $200 per person per night. All day visitors must leave by 10:00 PM. The booking guest is responsible for all conduct, damages, and rule compliance for their group and invitees.

4. Quiet Hours and Conduct

Quiet hours are strictly enforced from 10:00 PM to 6:00 AM. Excessive noise, loud music, parties, or disturbances are prohibited. Smoking or vaping is not allowed indoors, in the hot tub area, or within 15 feet of doors or windows. Violations incur a $300 fine plus odor remediation. Firearms, illegal drugs, and fireworks are prohibited. Commercial filming is allowed only if it does not involve adult content, violate HOA rules, or disturb neighbors.

5. Pets

A maximum of two pets is allowed per stay. A $15 per pet fee is charged through the booking platform. Pets must not be left unattended, must remain off furniture, and must not cause noise or damage. Guests are responsible for all pet-related cleaning and repairs. Pet damage is subject to actual cost plus a $75 administration fee.

6. Assumption of Risk and Liability Waiver

Important: Guest assumes all risk of injury, death, or property loss arising from use of the premises, including stairs, hot tub, fire table, grill, appliances, and outdoor areas. Guest agrees to release and hold harmless Luxe Den LLC from claims caused by ordinary negligence. This waiver does not apply to gross negligence or willful misconduct. Children under 14 must be supervised at all times outdoors and near the hot tub.

7. Damage, Fees, and Charges

Guest authorizes charges for any loss or damage beyond normal wear and tear. These include:

  • • $150 for excessive cleaning
  • • $250 for hot tub contamination
  • • $30 per missing towel or linen
  • • $50 for lost key or lockout service
  • • $250 for tampering with cameras, smart locks, or Wi-Fi
  • • $300 plus odor removal for smoking violations
  • • $200 per unauthorized guest per night
  • • Actual cost plus $75 administrative fee for pet-related damage
  • • Full repair cost for water damage or flooding

8. Security and Surveillance

Two exterior cameras are installed—one facing the driveway, one facing the guest entrance. No interior cameras are used. Tampering with cameras, smart locks, or network equipment is strictly prohibited and will result in a $250 fee and possible removal.

9. Parking Guidelines

  • One vehicle may park in front of the left-side gate, overlapping the third garage bay. Do not block the main garage.
  • Additional vehicles must park on the opposite side of the street or in guest parking near the park.
  • Do not park on the home's side of the street; this is a no-parking zone. Vehicles may be towed at guest expense.

10. Check-In and Check-Out

Check-Out

No later than 11:00 AM

There is no fee for late checkout, but failure to vacate on time may be treated as trespass. No squatter's rights, tenant claims, or holdover privileges apply.

11. Governing Law and Legal Provisions

This agreement is governed by Utah law. Any dispute not subject to platform arbitration will be resolved in Utah County Justice Court for claims under $11,000 or in the Fourth Judicial District Court in Provo for higher claims.

Guest agrees to indemnify and hold harmless Luxe Den LLC from all liabilities, damages, and enforcement costs arising from any breach of this agreement. In any action to enforce terms or recover losses, Guest agrees to pay all attorney's fees, court costs, and collection expenses.
